The region’s network of skilled nursing facilities, assisted living communities, board and care homes, and adult day care centers serves tens of thousands of elderly residents at any given time. When something goes wrong inside one of these facilities, families often discover it too late — and they need a lawyer who understands both California’s elder abuse laws and the way Orange County’s courts handle these cases.
Elder abuse cases are not ordinary personal injury claims. California’s Elder Abuse and Dependent Adult Civil Protection Act (Welfare and Institutions Code section 15600 and following) created a separate statutory framework for cases involving people 65 and older or dependent adults. When the statute applies, plaintiffs can recover attorney’s fees and, where the facility’s conduct rises to the level of recklessness or malice, enhanced damages that include the victim’s pain and suffering even after death — an exception to the general rule that pain and suffering damages die with the victim.
These cases turn on details that take real investigation: nursing facility staffing records, the patient’s care plan, charting and assessment notes, incident reports, and the medical and pharmacological records that show what was actually happening day by day. Adult Protective Services (APS) for Orange County investigates reports of elder abuse and neglect at the county level. Civil litigation and APS investigation can proceed in parallel — APS findings often inform a civil case, and APS investigators sometimes serve as witnesses. A facility’s licensing is regulated by the California Department of Public Health (CDPH) for skilled nursing facilities and by the California Department of Social Services (CDSS) for residential care facilities for the elderly (RCFEs) and adult day care centers. Complaints to these agencies create paper trails that can become evidence in civil litigation.
Most civil elder abuse cases involving Anaheim residents are filed in the Orange County Superior Court’s Central Justice Center in Santa Ana. Complex multi-defendant cases may go to the Civil Complex Center. Cases originating in north Orange County may go to the North Justice Center in Fullerton. California’s Elder Abuse and Dependent Adult Civil Protection Act applies statewide, including to all elder abuse cases arising in Anaheim and Orange County. The statute defines elder abuse to include physical abuse, neglect, financial abuse, abandonment, isolation, and treatment causing physical harm or mental suffering. Victims must be 65 or older, or a dependent adult between 18 and 64 with physical or mental limitations.
Most elder abuse claims must be filed within two years of the abuse or neglect. Financial elder abuse claims allow four years. Wrongful death cases involving elder abuse generally allow two years from the date of death. Statutes of limitation are easy to miss — contact an attorney as soon as you suspect abuse.
