Adult Protective Services (APS) for Los Angeles County investigates reports of elder abuse and neglect at the county level. Civil litigation and APS investigation can proceed in parallel, and APS findings often inform a civil case, with APS investigators sometimes serving as witnesses. A facility’s licensing is regulated by the California Department of Public Health (CDPH) for skilled nursing facilities and by the California Department of Social Services (CDSS) for residential care facilities for the elderly (RCFEs) and adult day care centers. Complaints to these agencies create paper trails that can become evidence in civil litigation.
Most civil elder abuse cases involving Los Angeles residents are filed in the Los Angeles County Superior Court. For cases arising in the city’s Central District, the primary filing location is the Stanley Mosk Courthouse at 111 N. Hill Street in downtown Los Angeles. Depending on where the facility is located and where the harm occurred, a case may instead be assigned to one of the county’s other district courthouses. The choice of courthouse depends on the case’s circumstances and the court’s venue rules.

California’s Elder Abuse and Dependent Adult Civil Protection Act applies statewide, including to all elder abuse cases arising in Los Angeles and Los Angeles County. The statute defines elder abuse to include physical abuse, neglect, financial abuse, abandonment, isolation, and treatment causing physical harm or mental suffering. Victims must be 65 or older, or a dependent adult between 18 and 64 with physical or mental limitations.
Most elder abuse claims must be filed within two years of the abuse or neglect. Financial elder abuse claims allow four years. Wrongful death cases involving elder abuse generally allow two years from the date of death.
